It's not another day...It's NOT another Independence Day either..

Seating in a small village named Tundiya, of Banaskantha district of North Gujarat. People in the village are simple, most of them dependent on small rainfed agriculture, and minor forest produce called Timbru leaves collection and daily labour work, if available. With no guarantee of regular income, each family has its own story of struggle for survival, but amazingly they have beautiful smile on their face, they become happy with little things and occasions and satisfied with two meals they gain with so much struggle.
For last few months, we have started interacting with villagers here (around 40 villages) and found that negligible percentage of household gets full ration quota from PDS shops, despite their name appears in the National Food Security Act, priority House Hold list. Every village has considerable number of old age, widows, who have not even applied for the scheme, becoz either they are not aware or not being able to get dozen number of documents asked along with the form of application.
Revenue records of land holders not updated, again becoz the bribe rate per bigha of land for doing the procedure is high and people cant afford it.
On system side, key positions like block development officer, is either vacant or some incharge person who comes only for few days. Offices remain silent, and vacant till 11:30 am at least...with peon, and contract based computer operator answering visitors that officers will come soon.
We are on eve of 2nd decade of 20th century. Eve of 73 years of Independence there are thousands of villages across the country in similar situation...
We may blame Government, Adminstration, System or Politician. But all created by YOU and ME.
Then its not another independence Day for me....as I need to think of my creation...!! 

માહિતી અધિકાર સુધારા બિલ 2019

 માહિતી આયોગની સ્વાયતતા છીનવાઇ. ! 

માહિતી અધિકાર કાયદો તંત્રને પારદર્શી અને જવાબદેહિ બનાવવા નાગરિકના હાથમાં એક અસરકારક ઓજાર સાબિત થયું છે. છેલ્લા 14 વર્ષોમાં દેશભરમાં નાગરિકોએ તેનો ભરપૂર ઉપયોગ કરીએ ભ્રષ્ટાચારને ખુલ્લો પાડયો છે, ગેરરીતિઓને ઉજાગર કરી છે, અને સરકારના અનેક નિર્ણયો, નીતિઓ વિશે મહત્વના તથ્યો, હકીકતો લોકો સમક્ષ મૂકી છે. એટ્લે સ્વાભાવિક છે, કે આ કાયદો તંત્ર અને રાજકીય નેતાઓ બંનેને ખૂંચે.

આ કાયદો પસાર થયાના 6 મહિનાની અંદરજ ફાઇલ ઉપરની નોંધ ન આપવાની જોગવાઈ કરવામાટે સુધારા બીલ મૂકવાની કોશિશ થઈ હતી. ત્યારથી અત્યારસુધી અનેક વખત આ કાયદામાં સુધારો કરવાના નામે તેને નબળો પાડવાના પ્રયાસો થયા છે. દરેક વખતે સુધારા બીલની સામે દેશભરમાંથી નાગરિક જૂથો, કર્મશીલો અને પ્રસાર માધ્યમોએ અસરકારક આંદોલન કરી સરકારના પ્રયાસોને સફળ થવા દીધા ન હતા.

સંસદના ચાલુ ચોમાસા સત્ર દરમ્યાન 22 જુલાઇના રોજ લોકસભામાં માહિતી અધિકાર સુધારા બીલ 218 વિરુદ્ધ 79 મતોથી પસાર થયું. આ બીલ ગત વર્ષે સાંસદમાં ટેબલ થયું હતું, પણ તે પસાર થઈ શક્યું ન હતું. આ વખતે આ બીલ એકદમ રહસ્યમય અને નાટ્યમય રીતે એજન્ડામાં મુક્યા વગર ખાસ પરવાનગીની વિનંતી કરી મંત્રીશ્રીએ રજૂ કર્યું. સામાન્ય રીતે ખરડાને વેબસાઇટ પર મૂકવા, મંતવ્યો મંગાવવા, અથવા ચર્ચાસત્રો ગોઠવવા જેવી ચાલતી આવેલી પદ્ધતિને બિલકુલ અવગણના કરીને આ ખરડો લોકસભામાં રજૂ થયો.

માહિતી અધિકાર બીલ રજૂ કરતી વખતે મંત્રીશ્રી જીતેન્દ્ર પ્રસાદે તેને ‘માહિતી અધિકારને મજબૂત કરવામાં માટેનો પ્રયાસ તરીકે ગણાવી રજૂ કર્યું, જે તદ્દન ખોટું છે. આ સુધારા બીલનો દેશભરમાંથી કર્મશીલો, માહિતી અધિકારના કાર્યકર્તાઓ, નાગરિક જૂથો, તેમજ નિવૃત્ત માહિતી પંચોએ ખૂબ વિરોધ કર્યો છે અને  તેને ઈરાદાપૂર્વક કાયદાને નબળો પાડવાની પગલું તરીકે ગણાવ્યું છે.

શું ફેરફાર થયા?

મૂળ કાયદામાં જોગવાઈ	સુધારો	સંભવિત અસર
માહિતી પંચના કામકાજનો સમયગાળો
મૂળ કાયદા અનુસાર દરેક રાજ્ય તથા કેન્દ્રમાં 10 થી વધુ નહીં તેટલા માહિતી કમિશ્નર નીમી શકાય છે. કોઈને પણ કમિશ્નર તરીકે નિમણૂંક મળે એટ્લે તે વધુમાં વધુ 5 વર્ષ અથવા 65 વર્ષ પૂરા થાય (બેમાંથી જે પહેલા આવે તે) ત્યાં સુધી કમિશ્નર તરીકે ફરજ બજવી શકે, અને કોઈ સંજોગોમાં તેઓ ફરીથી કમિશ્નર બની શકે નહીં તેવી જોગવાઈ કદમાં છે.	કમિશ્નરશ્રીઓનો કામકાજનો સમય ગાળો કેન્દ્ર સરકાર નક્કી કરશે. એટ્લે તમામ રાજ્યોના માહિતી પંચ પણ કેટલા વર્ષ કાર્યરત રહેશે તે કેન્દ્ર સરકાર નક્કી કરશે.	કોઈ કમિશ્નરશ્રી ના ચુકાદા સરકારને માફક આવે તેવા હોય તો તેમણે  પુન: નિમણૂંક આપવાની જોગવાઈ પણ કરી શકે. સરકારને ઈચ્છે તો તેમનો સમયગાળો ઓછો પણ કરી શકે. શું નક્કી કરશે કેવી રીતે, તે બધુ કેન્દ્ર સરકારના આધીન રહેશે. તેથી પુન: નિયુક્તિની અપેક્ષાએ સરકારને અનુકૂળ થવાનું વલણ ઊભું થઈ શકે.
માહિતી પંચનો પગાર
મૂળ કાયદાની જોગવાઈ મુજબ કેન્દ્રિય માહિતી પંચને મુખ્ય ચૂંટણી કમિશ્નરશ્રી સમકક્ષ અને રાજ્ય માહિતી પંચોને રાજ્ય ચૂંટણી પંચ સમકક્ષ ગણવામાં આવ્યા છે.	હવે તેઓનો આ દરજ્જો સુધારા બીલથી છીનવાઇ ગયો છે, અને તેમણે ડેપ્યુટી સચિવશ્રી જેવા કક્ષાએ લાવવાવની કોશિશ છે.	જ્યારે હાઇકોર્ટ અથવા સુપ્રીમ કોર્ટના માહિતી અધિકારી અથવા PMO ઓફિસ અથવા CMO ઓફિસ જેવા ઉચ્ચ કક્ષાઓની કચેરીઓને માહિતી ન આપે તે કિસ્સાઓમાં તેમની સમક્ષ દંડાત્મક અને શિસ્તભંગના પગલાં લેવામાટે કાર્યવાહી કરવા માટે ભલામણ કરવાની સત્તા આયોગો પાસે છે. પણ જ્યારે તેમનં હોદ્દો આજના હોદ્દાથી નીચે આવી જશે ત્યારે તેઓ ઉપલી કક્ષાઓની કચેરીઓને જવાબદેહી નહીં બનાવી શકે,
સેવાની શરતો/ નિયમો
મૂળ કાયદાની જોગવાઈ અનુસાર માહિતી કમિશ્નરશ્રીઓના સેવાઓ માટેના નિયમો કોણ બનાવશે તે સ્પષ્ટ નથી. કેટલાક આયોગોએ તેમના માટેના નિયમો ઘડી કાઢ્યા હતા. (કલાકો, સુનાવણીઓ ક્યારે થશે, ફોર્મ વગેરે માટે)	સેવાઓની શરતો અને કામકાજ માટેના નિયમો કેન્દ્ર સરકાર નક્કી કરશે.	નિયમોની જરૂર છે. પણ તે માત્ર કેન્દ્ર સરકાર નક્કી કરશે તો રાજ્યોની સત્તા પણ કેન્દ્ર છીનવી લેશે. તેનાથી બંધારણમાં આપેલ ફેડરલ સ્ટ્રક્ચર (સમવાયી માળખા) ને પણ ધક્કો પહોંચે છે. સત્તાનું કેંદ્રિયકરણ થવાથી માહિતી આયોગ કેન્દ્ર સરકારનો એક વિભાગ બની જશે, તેમણે અંકુશમાં રાખશે. અત્યારે માહિતી આયોગ પાસે માહિતી માંગવી હોય તો રાજ્યના નિયમો લાગુ પડે છે. કેન્દ્ર નિયમ ઘડી કાઢશે તો તે મુજબ રાજ્યની અંદર જુદી- જુદી ફી અને પ્રક્રિયા હોય શકે.

આ સુધારા બીલનો વિરોધ પક્ષ તેમજ અન્ય પક્ષોએ ખૂબ વિરોધ કર્યો. “આજના કાયદામાં જ્યારે આયોગના કાર્યકાળની વાત સ્પષ્ટ છે, ત્યારે કેન્દ્રિય સ્તરેથી સરકારે તે માટે નિયમો ઘડવાની શું જરૂર? માહિતી પંચ સ્વતંત્ર અને સ્વાયત્ત હોવું તે તેમની અસરકારકતાનું મુખ્ય આધાર છે. એવા સંજોગોમાં કેન્દ્ર સરકાર તેમના પર અંકુશ લાવીને તેમને તાબે કરવા જઈ રહી છે, જે બિનલોકશાહી

વલણ છે”, તેવી આકરી ટીકા સાંસદો દ્વારા થઈ. પણ મંત્રીશ્રી જીતેન્દ્ર પ્રસાદે “માહિતી અધિકાર કાયદાઓ રાજ્ય અને કેન્દ્ર એમ બંને યાદીમાં નથી, પણ માત્ર કેન્દ્રિય યાદીમાં છે, તેથી અહીંથી જ આ બધું નક્કી કરવું પડે તેમ છે”, તેવી ગેરમાર્ગે દોરતી માહિતી સાંસદમાં આપી બિલ રજૂ કર્યું. હકીકતમાં માહિતી અધિકારનો ઉદ્ભવ બંધારણની કલમ 19 ના રૂએ આવેલ છે. કેન્દ્રનો કાયદો આવ્યો તેના પહેલા અનેક રાજ્યોએ (ગોવા, રાજસ્થાન, મહારાષ્ટ્ર, તામિલનાડુએ કાયદો પસાર કર્યો હતો.

માનવ અધિકાર આયોગ, બાલ અધિકાર આયોગ, મહિલા આયોગ જેવા આયોગો પાસે માત્ર ભલામણ કરવાની સત્તા છે. માહિતી આયોગ પાસે 25 હજાર સુધી દંડ કરવાની અને ખાતાકીય તપાસ કરવામાટે કહેવાની, તેમજ સુનાવણી વખતે સોગંદપર જુબાની લેવાની, સાક્ષીઓને બોલાવવાની, સરકારે નિર્દેશ કરવાની સત્તા છે. આયોગોએ તેના આધારે રાષ્ટ્રપતિ ભવનને પણ જવાબદેહી બનાવ્યું છે. વડાપ્રધાનની શૈક્ષણિક ડિગ્રીની વાત હોય કે, RBI માંથી મોટા ડિફોલ્ટરોની યાદીની વાત હોય, કે ડી-મોનીટાઈજેશન પછી કેટલા બેંકોમાં જમા થયા? કે મુદ્રા લોન કોને કોને મળી? કે કેટલા જાણ ધન ખાતા એક્ટિવ છે? વગેરે સરકારને માફક ન આવે તેવી માહિતી નાગરિકોને આયોગ થકીજ મળી છે. તેનો બદલો લેવા સરકારે આ કાયદો બદલ્યો છે.

છેલ્લા બે વર્ષથી કેન્દ્ર સરકાર દિલ્લીમાં વખતો વખત રાજ્યના આયોગોમાટે કાર્યશાળાઓનું આયોજન કરે છે. જેનો હેતુ અનુભવોની આપ- લે કરવાનો છે, તેવું કેન્દ્ર સરકાર કહે છે. ત્યાર બાદ તમામ આયોગોનું એક સંગઠન બન્યું તેમણે કેન્દ્ર સરકારે ફંડ પણ આપ્યું. ધીરે ધીરે તમામ આયોગોમાં તેઓ કેન્દ્ર સરકારની તાબામાં છે, તેવી લાગણી અને વાતાવરણ બનાવવામાં સરકાર સફળ રહી. એટ્લે જ્યારે આ બિલ રજૂ થયું ત્યારે આખા દેશભારમાંથી કોઈ આયોગે તેની સામે સવાલ કર્યો નથી. આ એક ચોંકાવનારી અને ચિંતાજનક  બાબત છે.

આ બીલને પસાર કરવાના પગલાં ઉપરથી બીજી એક વાત પણ પુરવાર થાય છે, કે કેન્દ્રને રાજ્યોપર અને તેમની માહિતી આયોગોના સંદર્ભમાં જરૂરી નિર્ણયો કરવાની ક્ષમતા પર ભરોસો નથી. એક હથ્થું શાસનની આ નિશાની છે અને તે ખૂબ જ ગંભીર બાબત છે.

આ ખરડા પર કોઈ ચર્ચા થઈ જ નથી, તેમ છતાં, સિલેક્ટ કમિટી અથવા સ્ટેન્ડિંગ કમિટી સમક્ષ આ ખરડાને મુકવાની માંગણીને ગણકાર્યા વગર, તેમજ સાંસદ બહારno આક્રોશ, લાગણી અને સામાન્ય નાગરિકોની અપીલને બિલકુલ સાંભળ્યા વગર બહુમતીના જોરે આ સુધારો સરકાર લાવી છે અને તેનાથી માહિતીના અધિકારને સીમિત કર્યો છે. લોકશાહીમાટે આ દુખદ અને ન સ્વીકારી શકાય તેવી ઘટના છે.

Every person has come with original Sanskar peace, wise, happy, and giving happiness to others. But as we come on our journey we acquire anger, sadness, and dissapointment, sanskar and those got recorded and we keep on playing it 

there are merged Sanskar and emerged one. we want good sanskar to emerge out. Thus we need to change our thoughts. 

Other person is going to think different from us. It is their Sanskar and they are right according to them, It does not affect me anyway. i am powerful soul and peaceful soul. A positive vibrations makes environment positive, and charged. 

To start with we need to only control our anger and should not allow it to come in words. then it will not come in deeds. After some time, our mind will also start thinking differently. 

This is expectation to acceptance journey. It's so easy to say, i dont want anything, but we keep creating thoughts that "we were expecting something from them and they did not meet our expectations. this creates negative throughts, and which affects our battery and sanskar. So one simple thing to start changing throught process is actually understanding that people are different because they come from different journey and we need to accept them instead of expecting them to be my way.

We dont angry on our boss, or our father. But we do get angry on wife, or children. That means we choose when to get angry and when to not. So lets choose not to get angry always.

Birth Sex Ratio of Ahmedabad in 5 different zones is less that state and national average. And this has become a great concern for members of an advisory committee under PC and PNDT Act. Every district has such committee which not only looks into the cases for violation of above Act, but also works for awareness generation on declining Sex Ratio in India, particularly in the locality. 

As per provisions of the Act, every doctors who is doing Sonography of pregnant mother, has to fill form F online, and also physically in two copies with signature of patient, and declaration from the Doctor doing Sonography. Sonography machine has specific registration number, which need to be renewed from time to time with district authority. The address of the machine, from where it is being operated is also important. 

However it is observed that many of the doctors are either ignorant of these provisions, or they just ignore it. Both situations becomes very serious... as it may have direct connections with declining sex ratio. In fact honourable supreme court has given a judgement that incomplete filling of form F is very serious offense and should not be tolerated. 

If there is violation of PC & PNDT Act, authority has power to search and seize, and seal the machine and also launch a criminal complaint against the person who is responsible for the same. Many criminal cases are filed every year under PC & PNDT Act at Ahmedabad metropolitan court, but rate of conviction is low. 

Ahmedabad is one of fast growing cosmopolitan city with over 1 crore population. One one hand we have super-specialty hospitals which stands high in entire India, while on other hand, city is moving towards darkness of heinous crime either killing daughters or selecting not to have daughters. 

Medical Facilities in Goa....!!

My father is suffering for diabetics for past 25 years. Since last 5 -6 years he was having severe pain in his left leg for which we consulted many doctors. But none of the doctors could diagnose correct reason for such a pain. He undergone physiotherapy for months, Naturopathy, oil massage almost everything that we could in our vicinity.
Two years back, he got wound in his lower limb. it showed very slow healing. Antibiotic and daily dressing went on for months. Meanwhile, one doctor suggested Doppler Sonography, which showed problem in blood circulation in both the legs.
We went to GOA Medical College, too. We were told that, surgery in lower part of limb may not help much. However both the legs had by now become black and outer skin almost look dead. He had also lost sensation in the lower limb. Though wound was big, he could walk as he did not feel pain to that extent.
Meanwhile, we consulted Vascular Surgeon at Ahmedabad, Gujarat, and he told us that father need to go Angioplasty to understand where blockage in blood circulation was. Angioplasty was done, to diagnose blockages upto 70% in both the limbs just below knee.
Two week before his Peripheral Angioplasty was done (for left limb) here in Ahmedabad and blood circulation started.
When we approached GOA medical college, we were told that such surgery could have been done there too, and there was no need for us to come to Ahmedabad.
However website of Goa Medical College do not show any Vascular surgeon neither regular nor visiting consultant or expert. There is only Cardio Vascular Theocic Surgeon , who is different from Vascular Surgeon. We are worried that Angioplasty in lower limb in Goa is being done without having Vascular Surgeon.
There are lot many patients in Goa who suffer from severe leg pain, blackening of leg, or non functioning of limbs or slow healing of wounds. Normally it is being treated by general surgeon, or physician. There is very little awareness on this among people. Thus there are many many Goans who are suffering from slow healing wounds and living with that.
We will definately raise this issue with Chief Minister and Health Minister of Goa and hopefully they will do the needful.

Unknown hands of assistance...!!

It is said human being is social animal. But slowly we are turning into lonely animal. From a joint family, we have come into nuclear family, and from nuclear it single persons family. 

However, sometimes life makes you realize you are part of very large family, which you have never seen, never lived with ....

When someone in your family is hospitalized...and you are shaken from inside. You run from hospitals to path laborataries, and then to sonography, and CT scan clinics and Eco, and MRI imaging centers. A cycle of Reports, medicines, tests then again followed by reports and medicines starts which you feel has no end...

You are crossing the road but your mind occupied with thoughts of your dear one. Some one co-walker draws your attention to a vehicle coming, someone pulls you back at the last moment, and says gently "Be careful" .....You are seating in an auto, your face down, low. "Ben koi bahu bimar chhe?" an autowala inquires with concern. He takes an auto till the gate of path lab, and waits for you till you come up with reports and quickly drops you back to hospital. compassionately, we never ask you for waiting charge, and if you do not have change, he let go his 5-7 rupees, that might to considerable part of his profit per trip. 

You are looking out for tea without sugar, or sugar free eatables. Shopkeeper readily informs you about where you can get the same. a teastaller or juice maker, makes seperate tea for your dear one without sugar, with more milk the perfect as you want it to be...and he puts little more juice or tea when packs it... gives you extra cups without any complaints. 

Each one of them, indiretly through their compassionate behaviour, actually asking you about your dear one, requesting you to take care of yourself, and giving them wishes for speedy recovery of the ill. 

And you realzie that you are part of this universe... which is full of humans..Human being...!! you are not alone... You cannot be.. there are many unseen, unknown hands of assistance for you ... 

No...! he cannot be my Son..!!

Sujata, a lady from an upper middle class family in a metropolitan city. He as many others in her society love development. A four lane road, malls, lake, Gardens, River front and a metro. Waah..! what was not there in her city now. 

She was happy in her three bedroom flat in a posh area of the city. Her husband, working in a company, and boy studying in private school, off course English Medium, and it was one of the well known school in the city. She use to boast for being able to send her Son in such a elite school. 

But that was not enough to live in peace. Her mobile is alarming her with lots of messages sent from different people, who tells her that her city, her state and her country is in threat becoz of "those people". 

"A man with three wives, and 9 children and many more to come is XXX....!! Awake, or else they will occupy your country one day" her mobile tells her with picture of one average age person and 4-5 kids around him, all looking hungry." This message has enough strength to create a sense of disliking for that XX person, and for entire community to which that XX person belong too. But that was not enough even. This image has silently injected a feeling of fear and insecurity in her. "What if they attacked us?". They will..! they can..!!" 

Then her mobile showed her many such scary images of YY persons from same community. That was followed by some videos in which these YY persons were also given punishment, beating, screaming, helplessness and final blow to kill the person. Sujata was shaken from inside, NO!!" she attempted a protest. "Its obvious. They have to pay for their deeds. They cannot become part of our country" our Rashtra is Hindu Rastra" She was told with roar, followed by "Jai Sriram" a victorious shout. 

Sujata,by now is getting used to such 'incidences of (So called) instant justice', that her mobile is showing her frequently. Now her society. "You are changing, Sujata" her inner voice whispered feebly. But it was not only Sujata her cute Son was also changing. "You know people of YY religion are terrorist" Poor are not tax payers, but are looting us. Mummy, Servant is servant, why should I call her aunty? Mumma, India was already having rocket technology during ancient times. "Mummy, shudra are not allowed to celebrate" "Mummy non vegetarians are bad" He was very sharp and learning too much. He was growing big. 

it was quiet morning otherwise in her CITY. Some movie that was to be screened. But how can it be screened? It showed something on those "ZZ" community and injustice being done to them. It also talked against industries. Meaning no development? whats app messages, newspapers starting talking about strong reaction upon screening of the films. Some leader too gave statement that 'movie it against her religion. She agreed to the anger and violence ahead. 

By afternoon, a group of youngsters started running on motorbykes with ribbon on forehead and scarf around the neck. Within no time, it turned into a mob and started breaking car windows, scooters, shops, anything that comes in their minds. She switched on the TV, started looking at "live videos" coming one after another on her mobile. One video in which a boy with hockey stick in the hand and hitting a front glass of expensive car, soon someone set the car a blaze" "a blaaaast" ..flames going high and a boy with stick turned on to camera,...."NO....he cannot be my Son" Sujata shouted before falling down on the floor... her mobile still playing the video....!!

Can you imagine buying salt @ 15 paisa per kg?

Gujarat produces 72% of the total salt of India. In Gujarat, salt is being produced in Little Rann of Kutch, which is known as "Vadagaru Salt" and that along the coast, is called as "Karkacch Salt. 

Communities who possess of harvesting salt through traditonal method are identified as "Agariays" (Agar=Salt farm) . There are around 1.5 lakh Agariyas in Gujarat who earn their livelihood through salt farming. 

However the biggest irony is that the primary producer has to live their life in a situation that is similar to bondage labour, as they have to trade their salt in advance, for the requirement of money for salt farming. 

In the month of Septebmer, Agariyas move to the salt farms and returns by April/May. 

During eight months, they reside in harsh environments, extrement temparature upto 50 degrees and with no access to basic facilities like regular water supply, health care, education, transport etc. 

The reward of this hard work is some peanuts thrown by the traders. The price of the salt is pre-fixed by traders, which is as low as 15 paisa /Kg of Salt. 

Government have some welfare schemes like Safety kits, mobile health Vans, Schools at working place, Hostels in residential villages, Bycycle at subsidised rate, and Solar Water Pump System of Rs.2 lakh  at 80% subsidy. However the basic issues like access to means of production like land entitlements, access to formal credit system, support price and insurance cover to the produce are not being addressed. Unless that are done, there won't be significant change in the life of traditional Agariya. 

in 2014, former justice Shri M. B. Shah was asked to give a report to the state, on status of Agariyas in Gujarat and way ahead. In this report there has been clear mention about Suppor price, and market access, bank  credit and insurance to the salt produced by Salt farmers. 

This year Traders have declared price of 15 paisa per kg. You and me purchase salt f@Rs.15 or even 20/Kg. The plastic bag in  which the 1 kg salt is packed has more cost than 15 paisa .
